General Terms and Conditions

§ 1 – Scope of application
1) These general terms and conditions apply to all contracts for quad tours concluded between Quads – Minibikes Mallorca S.L. (organizer) and the participants.
2) The staff of the organizer is not entitled to make verbal agreements with the participants in connection with the contract that deviate from these general terms and conditions.
§ 2 – Conclusion of contract
1) The tours, possible routes, duration of the tour and prices presented on the website or in brochures are subject to change and non-binding.
2) The participant submits an offer by requesting a tour, which is accepted by the organizer through the confirmation of participation or invoicing.
§ 3 – Prices and payment
1) The prices include the statutory value added tax.
2) The prices include the commission of 20% to contracted partner agencies.
3) Payments can be made online via Quads – Minibikes.com or by bank transfer to a bank account specified by the organizer.
4) Payment must be made by bank transfer within 5 working days of receipt of the invoice.
5) Cash payment of a voucher is not possible.
§ 4 – Conditions of participation
1) Driving license:
Participation is only permitted on presentation of a valid driving license (B) and identity card. The participant must carry these documents with him/her during the entire tour. Participants who are unable to present a valid original driver’s license at check-in are therefore not permitted to participate. The right to payment is therefore excluded.
2) Exclusion of participants:
Persons who suffer from mental or physical illnesses or impairments and who could endanger their own health or that of third parties by participating are excluded from participation. Also excluded from participation are persons who are under the influence of alcohol, medication, other intoxicating substances or drugs.
Persons who have recently undergone surgery are expressly advised not to participate. Pregnant women are also advised not to participate for their own safety and the safety of their unborn child. Should such persons, contrary to this recommendation, nevertheless participate, Quads – Minibikes S.L. accepts no liability for any resulting injuries.
3) Payload:
Riders including payload are limited to a maximum of 150 kg. The motorized ability to act must be unrestricted in terms of height and weight. Passengers must generally be requested in advance from the organizer before participating in the tour. Special requirements/conditions of participation apply. It is strictly forbidden for the co-driver to change seats or swap places with the driver during the entire tour.
§5 – Safety briefing and rules of conduct
1) A safety briefing and then a test ride are carried out before each ride. Participation in this is mandatory for every participant.
2) In addition, the following rules of conduct apply, which must be conscientiously read and adhered to by every participant:
a. Participation is only permitted with suitable clothing and sturdy footwear
b. The participant must wear a helmet during the entire ride
c. If the participant requires a visual aid, this must be worn during the entire tour
d. Driving licenses must be carried during the entire tour
e. Overtaking other participants is prohibited
f. Disproportionate tire wear due to improper use (e.g. burn outs) must be avoided at all times
g. Instructions from the tour guide must always be followed
h. The use of cell phones or cameras while riding is prohibited. The use of selfie sticks is also prohibited for safety reasons.
i. Leaving the group is prohibited or only permitted on the instructions of the guide
j. The consumption of alcoholic beverages and drugs as well as the use of medication before and during the ride is prohibited
k. Swapping vehicles between participants is prohibited
l. Accidents, damage to property or personal injury during the tour must be reported to the organizer immediately
3) If anything is unclear, the participant must speak to the staff and have the regulations explained to them
4) If the guide judges the participant’s skills required for the tour to be inadequate after the safety briefing and test ride, the participant may be refused participation in the tour. A refund is not possible.
5) All instructions and decisions of the organizer and his guide are binding
6) Participation can lead to serious injury if the safety rules are not observed and the instructions of the organizer are not followed. Participants may be excluded from the tour in the event of violations or breaches of safety regulations and the guide’s instructions. The organizer reserves the right to claim any resulting damages.
§ 6 – Cancellation conditions
1) Participants can cancel up to 3 vehicles up to one week before the event without giving reasons and with a 100% refund. After expiry of this period, cancellation is no longer possible under any circumstances.
2) Participants who are unable to take part in the tour due to alcohol, drugs or medication will not receive a refund.
3) The organizer reserves the right to postpone or change the tour due to weather conditions that may endanger the safety of the tour and its participants. In the event of a postponement, the organizer will provide the participants with an alternative date after consultation with the participants. Usual weather conditions such as rain, wind or similar weather conditions do not constitute grounds for cancellation. The participant is responsible for providing appropriate clothing.
4) Participants who cannot present their original driver’s license will be excluded from the tour and will not receive a refund or an alternative date. Photos, copies or provisional driving licenses are not legally valid and will not be accepted under any circumstances.
§ 7 – Insurance
1) The participant is covered by the organizer’s liability insurance. In the event of damage caused by the participant, the participant is obliged to pay a deductible of 500.
§8 – Severability clause
1) Should individual provisions of these GTC and the safety instructions be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. Instead, the invalid or unenforceable provision shall be replaced by a provision that comes closest to the meaning and purpose pursued by the parties with the original provision. The above provisions shall apply accordingly in the event that the GTCs prove to be incomplete.
